Cannot use my marble deposit

SO i sent my explorer to find marble deposit.Sadly it got discovered on top of an existent stone mine which i cannot tear down therefore I cannot use the marble mine building and I am stuck since ( am lvl 17) i cannot have more then 1 deposit as of now.

Marble requires you to build a marble mason near the deposit, not on the deposit. The mine you see is just a graphical representation of the deposit, but not an actual mine.
